Case Law of the Supreme Court of the Republic of Slovenia<\/strong> &#8211; Further Interpretation of Conditions for Slovenian Citizenship<\/h3>\n\n\n\n<p>In ruling no. X Ips 41\/2021 of October 25, 2021, the Supreme Court of the Republic of Slovenia provided an interpretation of point 4 of the first paragraph of Article 10 of the ZDRS, concluding that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The applicant must have secured funds at least in the amount of the basic minimum income defined by social security regulations.<\/li>\n\n\n\n<li>The definition of funds is not limited to their form (monetary income) but also includes other assets with financial value (real estate, high-value movable property, company shares, etc.).<\/li>\n\n\n\n<li>The purpose of this condition is to ensure the applicant\u2019s social security and prevent them from becoming a burden on public resources and social services of the state.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key Considerations in Assessing Funds<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Continuous income reception:<\/strong>&nbsp;The law stipulates that an applicant must receive funds for a specified period without interruption, while exceptional circumstances, such as unemployment benefits, are also considered.<\/li>\n\n\n\n<li><strong>Combination of different income sources:<\/strong>&nbsp;If an applicant receives multiple types of income, their total amount is considered, provided that at least one meets the minimum requirement (e.g., at least two years of primary income and one year of additional income).<\/li>\n\n\n\n<li><strong>Impact of assets:<\/strong>&nbsp;The Supreme Court further emphasized that, besides regular income, other assets such as real estate ownership, financial savings, and other valuable assets also count as sufficient funds for material and social security.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The determination of sufficient funds for acquiring Slovenian citizenship is based on a combination of legal criteria, administrative practice, and judicial interpretation.
